For 35 years, Attorney Hambelton’s practice has focused on the litigation of civil matters primarily in the Massachusetts State and Federal Courts but also in the State Courts of Connecticut, Rhode Island, Vermont and New Hampshire on a pro hac vice basis. Attorney Hambelton has successfully tried approximately 200 cases to a conclusion, most of them jury trials. His areas of concentration are personal injury matters, including wrongful death, dramshop liability, motor vehicle liability, construction site accidents, professional liability-medical, dental, real estate, and nursing home- premises liability, traumatic brain injury and products liability. Attorney Hambelton also maintains a general business litigation practice involving such matters as contractual disputes and employment liability. Attorney Hambelton also has extensive experience in liability insurance coverage matters and bad faith claims. Attorney Hambelton has briefed and argued appellate matters several times before the Massachusetts Appeals Court, the Massachusetts Supreme Judicial Court and the First Circuit Court of Appeals. A sampling of Attorney Hambelton’s reported appellate decisions are:

    Makynen v. Mustakangas, 39 Mass. App. Ct. 309 (1995) (liquor liability verdict against Mr. Hambelton’s client reversed because of improper admission of evidence of post-time of last service conduct/appearance of the intoxicated driver)

    Kirby v. Morales, 50 Mass. App. Ct. 786 (2001) (directed verdict in favor of Mr. Hambelton’s client upheld based upon proper exclusion of a witness’s deposition testimony taken before Mr. Hambelton’s client was brought into the case and no meaningful opportunity to cross-examine existed) and

    Esturban v. MBTA, 68 Mass. App. Ct. 911 (2007) (grant of summary judgment in favor of Mr. Hambelton’s client, the T, upheld where plaintiff presented no expert opinion testimony regarding an allegedly defective escalator).

Attorney Hambelton’s successful trials have included the defense of a Swiss textile printing machine manufacturer in two Federal Court product liability cases, the defense of a restaurant in a double wrongful death liquor liability case, the defense of a nightclub in a traumatic brain injury case, the defense of a school for emotionally disturbed adolescents in a sexual abuse case, the defense of a major utility in a nuclear power plant construction accident case and the defense of an automotive jack manufacturer and distributor in a paraplegia case.
